In 1981, one of the outcomes of the Reagan Administration was the creation of a New Federalism which placed emphasis on devolution  each states needs are different and therefore should have more control over the design of the program, based upon each states priorities. By 1982, 37 states had taken over the State and Small Cities non-entitlement CDBG program from HUD. OREGON ASSUMED THE PROGRAM IN 1982. By 1987, 49 States had taken over the State and Small Cities non-entitlement CDBG program from HUD. To date, 49 states administer the non-entitlement CDBG program, with the exception of Hawaii. The agreement between HUD and the states is unique. The State cannot give the program back to HUD. Once the State accepted responsibility and entered into the agreement with HUD, the State became  HUD s arm OR quasi HUD staff. I have tried to limit the use acronyms, but If I use an acronym you are unfamiliar with please call it my attention so we can let everyone know what it stands for.QQ H  0.k ? ̙33 "4 b(  ^  S xXK   >  c $٬x M)  > XThe State of Oregon s program is federally restricted to serving non-entitlement cities and counties with populations of less than 50,000 or 200,000, respectively. Current Entitlement Counties: The counties of Washington, Multnomah and Clackamas are not eligible to apply under the States program. Current entitlement Cities: The cities of Ashland, Bend, Corvallis, Eugene, Gresham, Hillsboro, Medford, Portland, Salem, Springfield are not eligible to apply under the states program. Tribes:Tribes receive their own direct CDBG allocation from HUD, entitled the ICDBG program. Tribes are not eligible applicants under the states program. The administration of this program requires the state to complete many documents and reports for HUD. Five-Year Consolidated Plan  Usually involves 10-15 public participation meetings. This plan is a general plan, identifying the needs around the state and how the State intends to address these needs with the CDBG program, during the five-year period. The State is currently under the 2006  2010 plan, the next five year consolidated plan is due to HUD 45 days prior to the next five year cycle, or November 15, 2010. In addition the State is required to prepare and Analysis of Impediments to Fair Housing, and an action plan to address these impediments, the state is under the current plan dated 2006-2010. Annual Action Plan  Method of Distribution (MOD)- The MOD is the specific annual update to the five year consolidated plan that must address the federal statutory program requirements, application procedures, targeted funds, eligible activities and grant amounts. This MOD is incorporated by reference into OAR and must be submitted to HUD 45 days prior to the next program year. The next MOD submittal will be November 15, 2008, for the 2009 program year. Other - Consolidated Annual Performance Evaluation Report (CAPER): Not only does HUD require specific plans prior to the beginning of each program year, they require reports on the progress of each grant provided to the State. The CAPER is due to HUD 90 days after the completion of each program year. HUD also has special focus areas and goals for the use of the funds, such as ending chronic homelessness and hunger. To accomplish this objective all projects funded with CDBG funds are required to meet on of the three national objectives: Area Wide  area served must be comprised of 51% or more LMI persons (water, wastewater, fire stations, library districts, community centers etc.) Limited Clientele  If a facility serves sole one of the clientele groups presumed to be LMI by HUD, such as  Seniors over 60, homeless, abused children, battered spouses, severely disabled adults, illiterate adults, persons living with AIDS, and migrant farm workers, no data collection is required. (Senior Centers, domestic violence shelters, homeless shelters) If the facility does not serve a presumed group, family size and income data must be collected from the from users of the facility (head start, food banks, transitional housing) Jobs  51% of the jobs to be created or retained must be the type that can be made available to, made available to, filled or held by a LMI person. Housing  Housing rehabilitation& Collect household size and income from each family to be assisted. S/B  Area  Area must be officially designated by the grant recipient as a slum, blight, deteriorated, or deteriorating under state and local law, ORS 457.010. Complete applications are forwarded to: RATE and RANK group who rates and ranks all applications and forwards funding recommendations for review by the Senior Management Review Committee consisting of OECDD Senior Management and Representatives from AOC and LOC. The Senior Management committee reviews the recommendations from the rating and ranking team and forwards their funding recommendation to the Department Director for review and approval. The Director has the ability to concur with the recommendations or not fund any or all of the projects, as appropriate. All funding decisions by the Director are final. Additional Special Disaster Appropriation  The Governor requested a $4,000,000 special disaster appropriation from the CDBG program. These request needs your support. Anti-Pirating Rule - The Conference Report includes a provision instructing HUD to expeditiously issue guidance to CDBG grantees on complying with statutory restrictions related to "job pirating", i.e. using CDBG funds for business relocation. This provision appears to result from a recent Government Accountability Office (GAO) report that found that many grantees were not affirmatively implementing the intent of the statute. Grantees can now expect more guidance and vigilant monitoring on this issue. Eminent Domain - The bill also includes a prohibition on the use of any FY08 TTHUD funds, including CDBG funds, in projects where eminent domain is utilized, except for projects exclusively for public use. This is very similar to the provision included last year, and the intent is to prevent the use of federal funds for eminent domain on economic development projects that benefit private entities. The restriction does not apply to most mass transit, railroad, airport, seaport, and highway projects; as well certain utility projects and structures designated for use by the general public. Projects that involve the removal of an immediate threat to public health and safety or brownfields would remain eligible for federal funds. CDBG FORMULA REFORM: The CDBG formula allocation used by HUD is old, and uses outdated statistics such as 1930 s housing stock etc. In addition, the population limits for becoming an entitlement are under review, along with the  grandfathered entitlements. HUD prepared a draft updated/reformed formula allocation study in February 2005. As this is a draft, changes have been continually made to the study. The Office of Management and Budget (OMB) will complete their review of HUD s CDBG reform proposal for the States formula allocation by late fall 2007. OMB s review will be made available to the States for review. It is anticipated that the CDBG formula reform will taken before the FFY 2009 Congress. Once OMB has completed their review, the State will have a better idea of how this will impact the States CDBG program. OHCS Managed Programs - In addition, during 2007 OHCS received $5.1 million in application requests for the Housing Rehabilitation program when there was only $2.8 million available for award. The Housing Resource Center program received $696,000 in application requests for $482,486 of available CDBG funds. OECDD submitted a waiver request to HUD dated December 18, 2007, requesting waivers of certain federal requirements to allow the State to adopt an amended MOD in a more timely fashion, allow use of funds for pre-award costs, reduce local citizen participation requirements, increase to the state administration allowance so that state staff can spend more time in the field assisting communities.
