Special Public Works Fund
Emergency projects as a result of a disaster
In order to request and receive funding from the Special Public Works Fund the following conditions must exist:
  • Project funding will be used only for eligible activities required to return an Essential Community Facilities to its pre-disaster condition as a result of an "Emergency" as defined in ORS 401.025(4).

  • A federal disaster declaration must have been issued.

  • Benefited area must be included in designated disaster area.

  • Federal funds must be committed.

  • Project activities are not a duplication of costs paid under the Public Assistance Program.

  • The assistance must be for one of the following Essential Community Facilities: City Halls; city and county courts; County courthouses; community centers, including senior centers, youth centers, boys and girls clubs, head start facilities and day care centers; domestic violence centers; emergency services buildings, including 911 facilities, ambulance facilities and fire stations; emergency shelters, including homeless shelters and shelters for people with disabilities; facilities for abused children; facilities for migrant farm workers; food banks; police stations; jails; juvenile justice centers; libraries; medical facilities, including public health clinics, drug and alcohol treatment facilities, mental health treatment facilities and transitional housing for mentally ill.

  • The facility must be municipally owned.

  • Funding requested is local matching share (25%).


Other eligible activities
Other activities include pre-construction activities ad defined in ORS 285B.416(2) such as preliminary design and specifications (Planning Projects) or a phased project such as Design-Construction, which includes Direct Project Management costs (also a Planning Project).
 
 

Ineligible activities
Ineligible activities are those not expressly allowed under Division 42 Rules. Exception to the rules must be requested at time of application and determined to be allowable and directly related to the proposed construction project.
 
 

Funding
Funding for Emergency Projects may consist of a loan, grant or combination as determined by the department. The following criteria apply:
  • Project must be financially feasible.
  • Maximum grant to a municipality cannot exceed $1 million.
  • Grants cannot exceed 85% of total project cost.
  • Grants cannot be for more than the local match (25%).
  • Maximum Grant awarded from the fund in a biennium cannot exceed $2.5 Million.
  • No grant may be awarded from this program if the department has awarded a grant from another funding program.
 

Application requirements
  • Department invited application.
  • Over lapping municipal boundaries must be accompanied by an intergovernmental cooperation agreement.
  • Only complete applications will be processed.
 
 

Award criteria
  • Security for loan includes pledge of municipality's full faith and credit.
  • Eligible money in fund and available.
  • Other funds needed to complete the project are available and committed.

The department may provide other funding for projects that do not qualify under the Emergency Project category. More and complete details are available by referring to OAR Division 42 Rules or by contacting a department representative for your area.
